1. Overview
These Referral Program Terms ("Referral Terms") govern participation in the referral program operated by Houston's Own Lawn App, LLC ("HOLA," "we," "us," or "our").
These Referral Terms supplement our Terms of Service and Privacy Policy. Capitalized terms not defined here have the meanings given in the Terms of Service. If these Referral Terms conflict with the Terms of Service on a referral-specific matter, these Referral Terms control.
Participation in the referral program is voluntary and is offered at HOLA's discretion. The referral program is a promotional program only — it does not change the pricing, scope, or performance of any lawn care service, which is provided by independent contractors, not by HOLA.
2. Eligibility
- Referring customer. Any HOLA customer account in good standing may share its referral code.
- Referred customer. Only a new customer may be referred. A person is not a new customer if they have previously created a HOLA customer account or previously completed a paid job through HOLA. A referral applied by a person who is not a new customer is not eligible, and any resulting discount, reward, or credit may be withheld or voided under Section 8.
- One referral per referred customer. A referred customer may have at most one referral code applied to their account, and only before their first paid job. A referral code cannot be applied retroactively to a job that has already been booked or paid.
- No self-referral. A customer may not apply their own referral code, or a code obtained in exchange for payment or other consideration.
3. How a Referral Is Applied
A referral is applied when a new customer enters or follows a valid referral code before their first paid job. Once a first paid job is completed, the referred customer's eligibility to apply any referral code ends permanently.
Applying a code does not by itself guarantee a discount or a reward. Both depend on the conditions in Sections 4 and 5 being met at the time the qualifying job is booked and paid.
4. The Referred Customer's Discount
- The referred customer's discount applies to the referred customer's first paid job only.
- The discount applies to Easy Book bookings only. A first job booked through Pick-A-Pro (or any booking path other than Easy Book) does not receive the referral discount, and the discount cannot be transferred to a later job.
- The discount amount is the amount displayed in the app at the time of booking. Discount amounts may change, and the amount shown at booking is the amount that applies.
- Only one promotional discount may apply to a job. Where a customer qualifies for more than one offer, HOLA applies a single offer and the others do not apply.
- Program pause. If the referral program is paused or discontinued (see Section 9) before the referred customer books their first paid job, the discount is not applied. Because eligibility ends after the first paid job, a referred customer who books their first job while the program is paused loses the discount permanently and it will not be reinstated if the program later resumes.
5. The Referring Customer's Reward
- The referring customer earns HOLA credit only after the referred customer's discounted first job has been completed and paid for.
- The reward amount is determined at the time the reward is created and may vary by promotion or program tier. The amount shown on the referring customer's referral history is the amount that applies to that referral.
- Rewards are subject to a holding period before they become available, during which HOLA may review the referral for the conduct described in Section 7.
- A reward is not earned if the referred customer's first job did not actually receive the referral discount, is cancelled, refunded, charged back, or reversed.
- Rewards are personal to the referring customer's account and are not transferable.
6. Credit Value, Use, and Expiration
- Referral credit is a promotional credit with no cash value. It cannot be redeemed, exchanged, or transferred for cash, and it is not a gift card, stored-value instrument, or store credit.
- Credit may be applied only toward the cost of lawn care services booked through HOLA and is applied automatically to eligible bookings.
- Credit is not refundable. If a job to which credit was applied is cancelled, the credit is generally returned to the account balance; it is not paid out in cash.
- Credit expires 180 days after it is earned. Expired credit is removed from the account balance and cannot be reinstated.
- Credit has no value on account closure. Any unused credit is forfeited when an account is deleted or terminated.
- Taxes, fees, and any remaining balance after credit is applied remain the customer's responsibility.
7. Prohibited Conduct
The following are prohibited and will result in the loss of any related discount, reward, or credit:
- Applying your own referral code, or arranging for another person to apply your code on your behalf.
- Creating duplicate, fake, automated, or otherwise fraudulent accounts, phone numbers, addresses, or payment methods to generate referrals.
- Referring a person who is not a genuinely new customer, including household members or other accounts you control.
- Distributing referral codes through spam, unsolicited text or email, paid search advertising on HOLA brand terms, coupon or deal-aggregation sites, or any channel that misrepresents your relationship with HOLA.
- Selling, auctioning, or exchanging a referral code for payment or other consideration.
- Any other use of the referral program that is misleading, abusive, or inconsistent with its purpose of inviting real new customers.
8. Investigation, Withholding, and Voiding
HOLA may, at its sole discretion and at any time, investigate any referral, discount, reward, or credit; place a reward on hold pending review; withhold or delay a reward; and void any discount, reward, or credit that HOLA reasonably believes was obtained in violation of these Referral Terms or the Terms of Service.
Rewards are held for a review period before they become available, and a referral may be flagged for manual review during that period. In deciding whether to review, withhold, or void a referral, HOLA may consider any relevant factor, including:
- Whether the referring and referred accounts share a phone number, service address, household, or payment method.
- Whether the referred person had previously booked or received service through HOLA, whether or not that service was paid for.
- The number of referrals or rewards associated with one account over a given period.
- Any other indication that the referral was not an invitation to a genuinely new customer.
These factors are grounds for review and for voiding a reward at HOLA's discretion. They are not automatic disqualifications, and not every factor is detected automatically.
Where a reward has already been credited and is later voided, HOLA may deduct the corresponding amount from the account's credit balance. If the balance is insufficient, the shortfall may be written off at HOLA's discretion.
HOLA may also suspend or terminate participation in the referral program, or the underlying account, for repeated or serious violations.
9. Program Changes, Pauses, and Termination
HOLA may change, pause, or discontinue the referral program — including discount amounts, reward amounts, eligibility rules, and expiration periods — at any time and without notice.
If the program is paused or discontinued:
- Referral credit already earned and not yet expired remains available to spend, subject to Section 6.
- Rewards already earned and within their holding period will continue to be processed under the rules in effect when they were created.
- New referral codes cannot be applied, and no new discounts or rewards are created, while the program is paused. See Section 4 for the effect on a referred customer who books during a pause.
