1. Certification
Houston's Own Lawn App, LLC ("HOLA," "we," "us," or "our") is a marketplace provider under Texas Tax Code § 151.0242. HOLA certifies to each contractor ("Contractor," "you," or "marketplace seller") that HOLA assumes the rights and duties of a seller for purposes of Chapter 151 of the Texas Tax Code, including the duty to collect, report, and remit Texas state and local sales and use tax on all sales of taxable services that HOLA facilitates through the HOLA marketplace, in accordance with Tex. Tax Code § 151.0242(c).
This certification applies automatically to every sale made through the HOLA marketplace. You do not need to take any action to receive it.
2. What This Means for You as a Contractor
In plain terms: HOLA has already collected, and will report and remit, the sales tax on your marketplace jobs. You do not collect or remit tax on those sales yourself, and you should not collect additional sales tax from a customer on a job booked through HOLA.
Three obligations, and HOLA's certification only removes one of them. It helps to keep them separate:
- Holding a Texas sales tax permit — your own responsibility.
- Filing your own Texas sales tax returns — your own responsibility.
- Remitting the tax on marketplace sales — HOLA's responsibility, under the certification above.
HOLA's certification covers the third only. If you are located in Texas and you hold — or are required to hold — a Texas sales tax permit, you still file your own Texas sales tax returns on time, even if every one of your sales runs through the HOLA marketplace and even if you owe no tax for the period. A return showing no taxable sales is still a return that has to be filed.
On that return, the Texas Comptroller's guidance for marketplace sellers applies as follows:
- Item 1 — Total Texas Sales. Include the total amount of your marketplace sales facilitated by HOLA.
- Item 2 — Taxable Sales. Exclude those same marketplace sales. Because HOLA, as the marketplace provider, has certified that it collects and remits the tax on them, you do not report them as taxable sales and you do not remit tax on them again.
There is a narrow exception, and it is about where you are located, not where you sell: a qualifying remote seller — a seller located outside Texas — may not be required to hold a Texas sales tax permit when its only Texas sales are made through a certified marketplace. That exception does not apply to a contractor based in Texas.

3. Records
Both HOLA and you are required to keep records of marketplace sales for at least four years, consistent with Texas Comptroller recordkeeping requirements.
Your in-app tax statement (Earnings → tax statement) is your record of the tax HOLA collected on your behalf. You can view it at any time and download it as a CSV.
4. Scope — Marketplace Sales Only
This certification covers only sales made through the HOLA marketplace. It does not cover, and HOLA does not collect, report, or remit tax on, any work you sell directly to your own customers outside the HOLA marketplace — including customers you serve through your own independent business, word of mouth, or any channel other than a job booked and paid for through the HOLA platform.
Tax on sales you make outside the HOLA marketplace remains entirely your own responsibility, exactly as it would be for any independent business. This certification does not change, reduce, or otherwise affect your tax obligations for that separate work.
5. Accuracy of Information You Provide
This certification relies on the accuracy of the information you provide to HOLA, including your business location and the service address for each job. If information you provide is inaccurate, the tax HOLA calculates, collects, and remits may be affected. You agree to provide accurate information and to promptly correct any information you know to be wrong.

This certification is effective as of the date listed above. If HOLA updates this certification, we will post the updated version here with a new "Last Updated" date. Material changes, if any, will also be communicated through the contractor app or by email to your registered address.
